Trade terms of Bedandbreakfast ApS
Bedandbreakfast Aps is an organization which handles the marketing in connection with overnight accommodation. We were established in 1992 and Bedandbreakfast ApS has been registered with the Danish Register of Trade Marks. Bedandbreakfast Aps markets overnight accommodation through internet pages, consolidators and our own booking office.
Registration and marketing period Registration at the marketing programme of Bedandbreakfast ApS or its consolidators may take place through email, telephone or a registration form. The agreement may last either one year or several years and will have to be renewed by the end of each period. The agreement can be terminated by the end of a month. Paid annual fee, if any, will not be paid back. If a host should wish to terminate his agreement, he will still be obliged to undertake the bookings confirmed, with the same rights and obligations as if the host were still registered. Registration at the marketing programme of Bedandbreakfast ApS or its consolidators will be considered as an acceptance of the trade terms of Bedandbreakfast ApS or the consolidator.
Information of the overnight accommodation Marketing and information concerning facilities for the overnight accommodation shall at any time comply with the actual situation. At any time, the overnight accommodation shall comply with the legislation in force at the time in question together with the rules and guidelines from Bedandbreakfast ApS or its consolidators, in connection with their participation in the marketing programme. Bedandbreakfast ApS or its consolidators shall reserve their right to change or to delete incorrect information without any warning.
Bookings through Bedandbreakfast ApS or its consolidator booking office and homepage The host shall pay a commission to Bedandbreakfast ApS or its consolidators in connection with all confirmed bookings, made through Bedandbreakfast ApS or its consolidators’ homepage. The commission shall be minimum 10 per cent. Separate commission shall be paid for accepted bookings made through the Bedandbreakfast ApS booking office. In case a host, after receipt of a booking, should neglect to answer or rejects the booking, then Bedandbreakfast ApS or its consolidators shall reserve their right to correct the calendar information of the host in question and to pass the booking information or inquiries concerning the period in question further to other hosts within the area.
Prices The prices for overnight accommodation registered on the homepage of Bedandbreakfast ApS or its consolidators shall at any time comprise bookings made through Bedandbreakfast ApS or its consolidators or their homepages or agents. Commission shall be calculated on the basis of the abovementioned prices. All other discounts or prices shall be irrelevant to Bedandbreakfast ApS or its consolidators.
Categories Bedandbreakfast ApS or its consolidators endeavour to visit all new hosts shall, however, not be obliged to do so. After the first visit, the overnight accommodation in question may be given a category, depending on its facilities. The present categories may be ordered by contacting Bedandbreakfast ApS or its consolidators. At any time, Bedandbreakfast ApS or its consolidators may change the terms and conditions for the categorization of the overnight accommodation. Without any warning, Bedandbreakfast ApS or its consolidators may at any time visit an overnight accommodation in order to check whether the informed situation and the present situation correspond to one another. The overnight accommodation shall be obliged to inform Bedandbreakfast ApS or its consolidators about any changes which may have an influence of the overnight accommodation, or which in any other way may have an effect on the overnight accommodation. In case a host has given incorrect information, then the overnight accommodation may lose its right to a continuous cooperation with Bedandbreakfast ApS or its consolidators without the host having any possibility of making any claims, neither judicially or financially, towards Bedandbreakfast ApS or its consolidators.
Bedandbreakfast ApS trademark Everybody, who participates in the marketing programmes from Bedandbreakfast ApS or it sconsolidators, may without any additional costs use the information material from Bedandbreakfast ApS or its consolidators in their own marketing. In case the cooperation with Bedandbreakfast ApS or its consolidators should cease, the right to use information from and references to Bedandbreakfast ApS or its consolidators shall lapse. References in one’s own marketing material shall be removed immediately without any costs for Bedandbreakfast ApS or its consolidators. Our material and homepage shall be protected by section 1 of the Danish Act on Copyright .
Payment Bedandbreakfast ApS or its consolidators may charge the commission agreed between the host and Bedandbreakfast ApS or its consolidators directly with the guest in connection with the host’s confirmation of a booking, or by forwarding an invoice to the host. This amount will be considered as a prepayment / deposit of the booking. At any time, the overnight accommodation shall be obliged to comply with the terms of payment from Bedandbreakfast ApS or its consolidators. In connection with any payment or deposit through a cheque, a fee will be charged. In case the commission shall be paid by the guest in connection with the confirmation of the booking, the amount shall not be reimbursed by Bedandbreakfast ApS or its consolidators. In case the guest afterwards should wish to have his deposit reimbursed, due to any error or deficits from the host, the host shall be obliged to reimburse the amount at his own account. In case Bedandbreakfast ApS or its consolidators should be ordered to reimburse the mount, then Bedandbreakfast ApS or its consolidators may claim their right of recourse towards the host.
Breach of contract In case the overnight accommodation should commit a breach towards any of its obligations, then Bedandbreakfast ApS or its consolidators may delete the overnight accommodation from any marketing actions without any further warning. Costs, if any, in connection with the breach of contract shall be covered by the host.
Complaints In case Bedandbreakfast ApS or its consolidators should be presented to any complaints from a guest of any overnight accommodation, the complaint will be resent to the overnight accommodation in question. The host shall be obliged to answer Bedandbreakfast ApS or its consolidators in writing within a period of seven days. The host’s answer to the complaint will be communicated through Bedandbreakfast ApS or its consolidators to the complainant. Bedandbreakfast ApS or its consolidators shall reserve their right to mediate between the parties. No overnight accommodation, nor any hosts and nor any guests can make any claims towards Bedandbreakfast ApS or its consolidators, concerning any guest’s stay with any host. Copenhagen shall be the venue for Bedandbreakfast ApS and its consolidators.
Homepage To the largest possible extent, Bedandbreakfast ApS shall be obliged to have information of the overnight accommodation on its homepages. With immediate effect, any host at Bedandbreakfast ApS or its consolidators may be excluded, where the host should participate in any projects which may be detrimental to Bedandbreakfast ApS or its consolidators. The homepage may currently be changed without this having any influence on the registration.
Changes in duties/taxes In case any costs should be imposed on Bedandbreakfast ApS or its consolidators, on which Bedandbreakfast ApS or its consolidators has no influence, then the prices and the commission agreements may be changed with immediate effect. This shall also apply to imposed taxes and duties.
Changes of terms and conditions The terms and conditions may currently be changed and the hosts will be informed about these changes in advance. The way in which the host has been registered shall not be changed for as long as the host’s registration period shall last.
